BOLERO Project General Conditions of Use. 

Article 1. Purpose

The purpose of these General Conditions of Use (hereinafter referred to as "GCU") is to define the terms and conditions under which CIRAD makes the BOLERO Project website (hereinafter referred to as "the Site") available to Internet users (hereinafter referred to as "Internet users") and the manner in which Internet users access and use the Site. 
The purpose of the Site is to present to Internet users the BOLERO scientific project and its network of partners, as well as the activities and achievements carried out in the framework of this project. 
The version of these GTUs currently online (version 1.0 of 09/2022) is the only one that can be enforced during the entire period of use of the Site and until a new version replaces it. CIRAD reserves the right to modify these GTUs at any time and without prior notice, in order to adapt them to changes in the Site and its operation. 

Article 2. Access to the Site  

To access and use the Site, the Internet user undertakes to respect all the conditions described below. 

The Internet user of the Site acknowledges that he/she has checked that the computer configuration and the connection equipment he/she is using do not contain any viruses and are in perfect working order. 

It is the responsibility of each Internet user to take all appropriate measures to protect their own data, hardware and/or software from contamination by any viruses circulating on the Internet, and also to make proper back-ups of their data. 

Article 3. Management of the Site  

CIRAD endeavours to provide access to the Site 24 hours a day, 7 days a week, except in the event of force majeure as defined by the French Civil Code and subject to any

Consequently, CIRAD cannot guarantee the availability of the site and services, the reliability of transmissions and performance in terms of response time or quality. No technical assistance is provided for Internet users, either by electronic or telephone means. 

In order to manage the Site properly, CIRAD may interrupt the Site or part of the services, or limit access to all or part of the Site at any time without prior notice, all without any right to compensation. 

Article 4. Content of the Site 

The information and documents appearing on the Site and accessible through the Site come from sources considered reliable. 

However, this information and documents may contain technical inaccuracies and typographical errors for which CIRAD cannot be held responsible. CIRAD reserves the right to correct these errors as soon as they are brought to its attention. 

The information and documents available on the site may be modified at any time, and may have been updated. In particular, they may have been updated between the time they are downloaded and the time the Internet user becomes aware of them. 

It is strongly recommended that you check the accuracy and relevance of the information and documents made available on the site. 

CIRAD may delete or refuse to display content that is contrary to national and international laws, to good morals or that may disrupt the operation of the Site. 

Article 5. Intellectual property 

The Site is the exclusive property of CIRAD. 

All the content of the Site, the documentary holdings, texts, works, products, processes, code and illustrations posted online are protected by copyright, patent and by the law protecting databases, of which CIRAD is the producer within the meaning of Articles L. 341-1 et seq of the French Intellectual Property Code. 

All the photos and illustrations published on this site by CIRAD are the property of CIRAD or are used with the agreement of their authors within the strict framework of the site. 

Any reproduction, representation or adaptation of all or part of the Site by any individual or legal entity, by any means whatsoever, without the prior written consent of CIRAD, is prohibited and constitutes an act of infringement punishable under Articles L. 335-2 et seq of the French Intellectual Property Code.

If CIRAD accepts the reproduction, representation or adaptation of all or part of the Site by a natural or legal person, the latter undertakes to cite the author and the source, in accordance with article L.122-5 of the French Intellectual Property Code. 

Any reuse or extraction, in whole or in part, of the Site's databases by a natural or legal person is strictly prohibited. 

The fact that CIRAD does not initiate proceedings as soon as it becomes aware of these unauthorised uses does not mean that it accepts the said uses and waives legal action.

Article 6. Responsibilities

CIRAD may not be held directly or indirectly liable, in any capacity and for any reason whatsoever, for any direct or indirect damage or loss whatsoever, in particular

Those that may result from accessing, using or downloading content via the Site, in particular, damage or viruses that may infect the Internet user's computer or any other equipment.

Those caused by a failure, breakdown, difficulty or interruption in the functioning of the Site, scheduled maintenance operations, preventing access to the Site and/or the use of the services for the Internet user or any third party.

Those resulting from the interpretation or use of the information and documents available on the Site.

Those resulting from the occurrence of a case of force majeure as defined by the French Civil Code.

CIRAD shall not be liable for any damage or indirect loss suffered by the Internet user, such as loss of business, turnover, profit or data.

Article 7. Hypertext links

The Site may contain hypertext links to other sites on the Internet. Following the links to these other resources means that the Internet user leaves the Site. Any information accessible via these links to other sites is not under the control of CIRAD, which declines all responsibility for their content.

It is possible to create a link to the presentation page of this Site without CIRAD's express authorisation, provided that the link displays the Site in a new browser window or tab.

However, it is requested that CIRAD be informed in advance at benoit.bertrand@cirad.fr, which may at any time request that the link be removed immediately and without having to justify its decision.

Article 8. Applicable law and competent jurisdiction 

These General Conditions of Use and the content of the Site are governed by French law.

The Internet user and CIRAD agree that any disputes that may arise as a result of or in connection with the present Terms of Use, if they cannot be settled amicably within a reasonable period of time, shall be submitted to the competent French courts.

Article 9. Personal data protection

In accordance with the French Data Protection Act no. 78-17 of January 6, 1978, as amended, and the General Regulation on the Protection of Personal Data (RGPD) no. 2016/679/EU of April 27, 2016, CIRAD, as data controller, guarantees respect for the privacy of site visitors.
